How to File a Complaint Against a U.S. Attorney's Office
- 1). Download the Complaint Alleging Failure of Department of Justice Employee to Provide Rights to a Crime Victim Under the Crime Victims' Rights Act of 2004 form from the Department of Justice and United States Attorneys' Office website or from the specific United States Attorney's Office that you are filing against.
- 2). Contact the Victims' Rights Point of Contact in the U.S. Attorney's Office that you are filing against. Use the Offices of the United States Attorneys "Contact Us" page to find the state specific contact information of U.S. attorney's offices. Inform the point of contact that you are about to file a complaint, and he will provide you with information about your rights. The point of contact is an official in the U.S. Attorney's Office who receives complaints.
- 3). File the complaint within 60 days from when you realized that your rights had been violated. Fill in the complaint form by identifying the specific U.S. Attorney's Office you are filing against, the person who violated your civil rights, and how you believe your rights were violated. Fill in the date and sign the form.
- 4). Send the complaint to the U.S. Attorney's Office that you are filing against. - 5). Receive a notice from the Victims' Right Ombudsman upon it receiving your complaint. Wait to be notified whether your rights were violated and about the findings of the investigation against the employee. The employee will face disciplinary action if your complaint is credible.
