Sex offender(SO) laws are in place to notify and protect members of society from people who have been convicted of sex crimes. Sex offender laws and registration requirements vary by state. There are over 11,000 convicted SOs in the state of Alabama. Each offender must adhere to strict guidelines to avoid further violation of the law.
1. SO Registry
o If a person is convicted of a sex crime in Alabama, they are required to submit their DNA and register as a SO. They have five days from the time of their release from custody to register their legal address and employment, if applicable. Sex offenders cannot reside with children, other SOs or within 2,000 feet of a school or child care facility. The SO registry is available online through the Alabama Department of Public Safety. Failure to register is a Class C felony.
Restrictions
o SOs in Alabama are not permitted to knowingly be within 100 feet of their victims at any time. Convicted SOs are also not permitted to be within 500 feet of schools, playgrounds, daycare facilities, school bus stops, parks or other locations or businesses that are known to be in place to educate, entertain or care for children. A convicted sex offender cannot be employed within 500 feet of these types of locations and businesses.
Notifications
o The police chief or county sheriff is responsible for notifying residents who reside within 1,000-2,000 feet (depending on local law) that a convicted adult SO lives in the area. The chief or sheriff must also notify all schools and child care facilities within three miles of the registered SO's residence. Flyers should be mailed or hand-delivered to members of the community to notify them of a sex offender(SO) in their area. Notifications can also be posted at the police station or in the local newspaper.
Senate Bill 296
o In May 2011, Senate Bill 296, which is sponsored by Senator Cam Ward, passed the vote in the state Senate. The bill is designed to close several of the loopholes in current Alabama SO laws. The bill would address the issue of registration for SOs without permanent residency and the timelines for notification of SOs in the area. The police chief or county sheriff is responsible for notifying residents who reside within 1,000-2,000 feet (depending on local law) that a convicted adult SO lives in the area.
