    • 1). Register with local temp agencies or workforce centers to show that you are willing and able to work. Making the effort to go out and find work will help your case when your unemployment benefits claim is under investigation by the Department of Labor.

    • 2). Contact a lawyer experienced with filing unemployment benefit claims in your state. Unemployment benefits are regulated at the state level, so experience with your state's process can be vital. A lawyer will be needed to build the argument, and prove in court if need be, that you were working in a hostile environment or that your firing constituted a form of discrimination.

    • 3). Contact your state's unemployment offices within your state's Department of Labor and ask to be sent all required forms which must be submitted to claim unemployment. File the appropriate forms to claim your unemployment benefits with the state unemployment offices. In cases of voluntary separation, such as when an employee is fired, unemployment benefits may be contingent on fulfilling any voluntary separation criteria in state unemployment code.
