Oregon Sentencing Guidelines for Assault 4

    Class A Misdemeanor

    • In most Oregon cases, Assault 4 is considered a Class A misdemeanor. As such, the standard sentencing is 10 days in jail with two years of probation.

    Exceptions to Class A

    • Where an Assault 4 offense took place in the presence of a child or if the defendant has had prior altercations with the victim, then the Class A determination is changed to a Class C felony in which the standard sentence is 60 to 120 days in jail followed by two years probation.

    Other Classifications

    • Assault 4 may be downgraded to a Class B misdemeanor called Harassment that carries an eight-day jail sentence, which is often commuted, and two-year probation.
