Pennsylvania Real Estate Act
- Chapter five of the Pennsylvania Real Estate Licensing and Registration Act deals with the licensing of real estate brokers. The qualifications for a license include that the applicant is at least 21 years of age, has graduated from high school, has received 240 hours of real estate training in various areas and has relevant experience or at least three years of training.
- Chapter five of the Pennsylvania Real Estate Licensing and Registration Act also covers the qualifications necessary to receive a sales person's license. These qualifications include that the applicant be at least 18 years of age, has had 60 hours of real estate instruction and has obtained a sworn statement from a broker that he will actively train and supervise the applicant.
- The act also sets for the criteria necessary to obtain a plethora of other licenses, including a cemetery broker's license, a cemetery salesperson's license, a builder-owner salesperson's license, a rental listing referral agent's license, a campground membership salesperson's license and a timeshare salesperson's license. Chapter six sets forth the ethical duties of licensees and some of the requirements necessary to maintain a license in good standing.
- The final chapters of the Pennsylvania Real Estate Licensing and Registration Act set forth the manner in which proceedings are held before the Pennsylvania Real Estate Commission, how the commission may adopt formal findings and the establishment of a real estate recovery fund, which is intended to help cover the cost of judgments based on liability arising from the act.
